By law, calls (also known in England and Wales as claims form and in the Australian state of New South Wales as Court Attendance Notice ) is a legal document issued by the court (a a subpoena ) or by a government administrative body (an administrative call ) for various purposes.

Court call

A court call is given to someone involved in legal proceedings. A legal action may be taking place against that person, or the presence of that person as a witness may be necessary. In the first case, the call will usually announce to the person being directed that the legal process has started against the person, and that the case has commenced in the issuing court. In some jurisdictions, this can be arranged in legal English that is difficult to understand by the layman, while some US states expressly require a call to be composed in plain English and that they should start with this sentence: "Notice! You have been prosecuted."

Calls announce the date on which the person or persons being summoned must appear in court, or respond in writing to the court or the other party or party. Calls are descendants of common law writings. This replaces previous procedures in the common law countries where the plaintiff must actually ask the sheriff to arrest the defendant in order for the court to obtain personal jurisdiction in both criminal and civil action.

They allow the recipient to avoid going to court by paying a fine set by law. If a notice is ignored or disputed, a subpoena will be issued for another violation.

Civilian call

Civilian calls are most often accompanied by complaints. Depending on the type of call, there is often the option to support the call so that the entities served can be identified. In the California court system, for unlimited civil cases in a superior court, calls will often have the following options:

  1. as an individual;
  2. as the person sued under the fictitious name __________________;
  3. on behalf of (usually for company); or
  4. with private delivery at __________

Administrative call

One example of an administrative call is found in the laws of taxation in the United States. The Internal Revenue Code authorizes the US Internal Revenue Service (IRS) to issue a summons for taxpayers - or anyone with custody of account books related to taxpayer business - to appear before the US Treasury or its delegation ( generally, this means the IRS employee who issued the call) at the time and place mentioned in the call. The person being called may be required to produce books, papers, notes, or other data, and to give testimony under oath before the IRS employee.

The IRS is also empowered to issue Article 7602 calls for the purpose of "investigating any violations related to administrative or internal revenue enforcement."

Calls may be enforced by a court order, and the law provides a penalty of up to one year in jail or a fine, or both, for failure to comply with a call, except that the called person may, to the extent practicable, affirm the privilege of self or other evidentiary right, if apply.

In the US immigration court system, "Notice to Appear" is an administrative call that instructs a respondent to appear before the immigration court for the removal process.

Calling by jurisdiction

Australia

In Australia's New South Wales (NSW) state, the Court's Notice of Presence Service may be issued in several ways, most commonly by the NSW Police Department when charging a person after the arrest, a Bail Notice of Presence Notice (with a guarantee provision) or a regular Court Attendance Notice issued. Other methods used by the Police include through a paper form called Field CAN Notice issued to a person accused in place after a violation has been detected. Or by way of Future CAN (Future CAN) Notice, which replaces the old court that issued a call and served directly by the Police or sometimes by post. In all these cases, CAN is filed in court after it airs.

England and Wales

Historically, in old English law, calls were called auxilium curiae, though the term is now obsolete. In England and Wales, the term call verb for the original document in the civil process has been replaced with the claim form by the 1999 Civil Registration Rules (CPR). This is part of the reform to simplify the legal terminology. However, regardless of its name, the claim form does not present the details of the claim itself (in other words, it does not replace the complaint). This complaint is now known as the claim description .

In a criminal matter, either a request, a call or a warrant is issued to initiate a criminal proceeding.

United States

In most US jurisdictions, calling services in most cases are required for the court to have jurisdiction over the called party. The process by which calls are called is called process services. The forms and content of services in federal courts are governed by Rule 4 of the Federal Rules of Civil Procedure, and the rules of many state courts are similar. Federal calls are usually issued by the court clerks. In many states, a summons may be issued by a lawyer, but some states use archiving as a means to initiate an action and in those countries, lawyers must first file a summons in duplicate before it becomes effective. One or more copies are stamped by the court clerk with a court stamp and returned to a lawyer, who then uses it to actually serve the defendants. Other jurisdictions may only require that a subpoena must be filed after being served to the defendant. New York is distinguished by a permissive filing system, where calls or complaints need not be filed at all.
